This section explains the rules that apply when you access or use Qaay, including account eligibility, verification, risk controls, regulatory checks, and automated protective actions. It should be read together with the Terms of Service, Privacy Policy, Cookie Policy, and any product-specific terms made available on the Platform.

1. General Use of the Platform

Qaay provides access to digital-asset-based financial tools and services, including wallet, portfolio, market, swap, borrow, lend, earn, and related account features. The availability of each feature may depend on the user’s location, account status, verification level, risk status, applicable law, internal security checks, and technical availability.

By using Qaay, you confirm that you will use the Platform only for lawful purposes and in accordance with these rules. You are responsible for understanding and complying with the laws, tax obligations, reporting duties, and restrictions that may apply to you in your country or jurisdiction.

Qaay may update, limit, pause, or discontinue certain features where reasonably necessary for security, compliance, risk management, product improvement, or legal reasons.

2. Eligibility

You may use Qaay only if you are at least 18 years old, or older where a higher minimum age applies in your jurisdiction, and you have the legal capacity to enter into binding agreements.

You may not use Qaay if:

  1. you are located in, resident in, citizen of, or otherwise connected to a restricted jurisdiction where access to the Platform is not permitted;
  2. you are subject to sanctions, asset freezes, or similar legal restrictions;
  3. your use of the Platform would violate applicable laws or regulations;
  4. you are using the Platform on behalf of another person without valid authorization;
  5. you provide false, incomplete, misleading, or outdated information.

Qaay may refuse, limit, suspend, or terminate access where it reasonably believes that eligibility requirements are not met.

3. Account Information and Verification

Qaay may request information and documents to verify your identity, account ownership, source of activity, eligibility, risk status, or compliance with applicable requirements. This may include identity information, contact details, nationality or country of residence, government-issued identification, selfie, address information, wallet-related information, transaction-related information, and other information reasonably needed for verification, security, fraud prevention, sanctions screening, AML/CTF checks, or risk control.

Verification may be required:

  1. before or after account activation;
  2. before access to specific features;
  3. when account activity changes materially;
  4. when required by risk, security, or compliance checks;
  5. when required by applicable law or a service provider involved in verification or compliance.

Qaay may use trusted third-party providers to support verification, fraud prevention, sanctions screening, AML/CTF checks, security monitoring, and related compliance processes.

If you do not provide requested information, or if verification cannot be completed, Qaay may limit, pause, refuse, or terminate access to some or all Platform features.

4. Restricted and Prohibited Activities

You must not use Qaay to:

  1. violate applicable laws, sanctions, export controls, financial crime rules, tax laws, or reporting obligations;
  2. engage in fraud, market abuse, money laundering, terrorist financing, evasion of sanctions, or other unlawful activity;
  3. hide or misrepresent your identity, location, source of funds, ownership, or purpose of transactions;
  4. use another person’s account, identity, payment instrument, wallet, device, or credentials without authorization;
  5. interfere with the security, integrity, availability, or operation of the Platform;
  6. attempt to bypass verification, risk controls, transaction limits, geographic restrictions, or security systems;
  7. use bots, scripts, automation, scraping, reverse engineering, or similar methods unless expressly permitted;
  8. exploit errors, delays, pricing issues, technical bugs, or system vulnerabilities;
  9. use the Platform in a way that creates unreasonable risk for Qaay, other users, service providers, or the integrity of the Platform.

Qaay may investigate suspected prohibited activity and take reasonable action to protect users, the Platform, and its service providers.

5. Credit Status, Risk Score and Qaay Oracle

Qaay may use internal systems, including Qaay Oracle, to assess market prices, collateral values, account health, transaction conditions, repayment status, asset volatility, liquidity, and other risk-related factors.

The Platform may display a credit status, risk score, health indicator, LTV range, collateral status, or similar risk information. These indicators are designed to help users understand account conditions and potential risk. They are not financial advice, investment advice, tax advice, legal advice, or a guarantee of future outcomes.

Risk indicators may change automatically and frequently due to market conditions, asset prices, collateral value, borrowing activity, repayment activity, liquidity, volatility, account behavior, system updates, or other risk factors.

You are responsible for monitoring your account, collateral, obligations, transaction status, alerts, and risk indicators. Market movements can be fast, and account conditions may change before you receive or read a notification.

6. Automated Calculations and Protective Actions

Qaay may use automated systems to calculate balances, collateral values, transaction quotes, available limits, account health, repayment requirements, alerts, fees, risk status, and other Platform conditions.

Where reasonably necessary to protect users, the Platform, collateral, liquidity, service providers, or market integrity, Qaay may apply automated or system-assisted protective actions. These may include:

  1. alerts and risk notifications;
  2. temporary limits on borrowing, lending, swapping, withdrawals, or other features;
  3. increased collateral requirements;
  4. partial or full repayment using available balances where permitted by the applicable product rules;
  5. collateral adjustment, restriction, or release based on account health;
  6. liquidation, auto-repayment, or similar risk-control actions where applicable product terms allow it;
  7. temporary account review, suspension, or feature restriction;
  8. transaction rejection, delay, cancellation, or manual review.

Qaay uses these controls to keep the Platform stable, reduce preventable losses, and help manage fast-moving market and security risks. Automated actions may be applied quickly where delay could increase risk.

Where a decision materially affects your account access, funds, obligations, or use of Platform features, you may contact support to request clarification or review, unless the action is required by law, sanctions, security, fraud prevention, or urgent risk-control needs.

7. Pricing, Quotes and Market Data

Prices, quotes, rates, collateral values, and market data shown on Qaay may be based on internal calculations, external market data, liquidity conditions, third-party providers, or a combination of these sources.

Displayed values may differ from prices available on other platforms. Quotes may expire, change, or be cancelled based on market movement, liquidity, slippage, volatility, technical delay, or risk controls.

A transaction is not final until accepted and confirmed by the Platform according to the applicable product rules. Qaay may reject, cancel, reverse, or correct a transaction where there is a manifest error, technical issue, suspected abuse, security concern, pricing disruption, or legal/compliance restriction.

8. User Responsibility and Risk

Digital assets and related financial services involve risk. Prices may be volatile, liquidity may change, transactions may be delayed or fail, and collateral value may decrease rapidly.

You are responsible for:

  1. understanding the risks before using any feature;
  2. keeping your account credentials secure;
  3. reviewing transaction details before confirming;
  4. monitoring your account, collateral, obligations, and notifications;
  5. maintaining sufficient balances or collateral where required;
  6. ensuring that your use of Qaay is lawful in your jurisdiction;
  7. obtaining independent legal, tax, financial, or investment advice where needed.

Qaay does not guarantee profits, returns, asset values, access to liquidity, uninterrupted service, or the availability of any feature.

9. Account Limits, Reviews and Restrictions

Qaay may apply limits or restrictions based on account verification level, jurisdiction, risk status, product rules, liquidity, security checks, fraud prevention, compliance obligations, or technical conditions.

Limits may apply to deposits, withdrawals, swaps, borrowing, lending, earning, transfers, account balances, transaction size, transaction frequency, collateral usage, or other Platform activity.

Qaay may review account activity and request additional information where reasonably necessary. During a review, some features may be delayed, limited, or temporarily unavailable.

10. Sanctions, AML/CTF and Compliance Checks

Qaay may conduct sanctions screening, AML/CTF checks, fraud prevention checks, wallet screening, transaction monitoring, risk assessments, and other compliance-related reviews.

Qaay may block, freeze, reject, delay, cancel, or report activity where required or permitted by law, sanctions rules, court orders, regulatory expectations, internal policies, or service-provider requirements.

Qaay may not always be able to explain the full reason for a restriction, delay, or refusal where doing so could compromise security, fraud prevention, sanctions compliance, AML/CTF controls, legal obligations, or an ongoing investigation.

11. Third-Party Services

Qaay may rely on third-party providers for hosting, infrastructure, analytics, customer support, identity verification, sanctions screening, payment or blockchain-related tools, market data, liquidity, security, communications, and other operational services.

Third-party services may have their own terms, privacy notices, risk warnings, or technical limitations. Qaay is not responsible for external wallets, blockchain networks, third-party exchanges, external liquidity providers, payment systems, or services not controlled by Qaay.

12. Errors, Delays and Service Availability

Qaay aims to provide reliable services, but the Platform may experience delays, interruptions, maintenance, degraded performance, incorrect displays, pricing disruptions, third-party failures, network congestion, smart contract or blockchain issues, cyber incidents, or other technical problems.

Qaay may pause or restrict features where reasonably necessary to protect users, reduce risk, investigate incidents, correct errors, or maintain Platform integrity.

13. Notices and User Communications

Qaay may send service messages, security alerts, risk notifications, compliance requests, product updates, and account-related communications through the Platform, email, in-app messages, push notifications, or other available communication channels.

You are responsible for keeping your contact details up to date and reviewing important notices. Failure to read a notice does not remove your responsibility to manage your account, collateral, obligations, or risk.

14. Review Requests and Support

If you believe that an account restriction, risk action, verification result, transaction issue, or automated protective action was incorrect, you may contact support and request a review.

Qaay will assess review requests reasonably, taking into account product rules, security requirements, legal obligations, available evidence, market conditions, system records, and applicable compliance requirements.

Some actions may not be reversible, especially where market conditions, blockchain settlement, liquidation, repayment, sanctions restrictions, legal obligations, or third-party limitations apply.

15. Changes to These Rules

Qaay may update these rules from time to time to reflect product changes, legal requirements, security needs, risk controls, operational improvements, or regulatory developments.

Where changes are material, Qaay will take reasonable steps to notify users through the Platform or other appropriate channels. Continued use of the Platform after an update means that you accept the updated rules.
